Foxwoods Casino Wins Cybersquatting Case - Thursday 15th of December 2005

MASSACHUSETTS – As reported by the Connecticut Day: "U.S. District Judge Janet C. Hall has found that a Dracut, Mass., man engaged in 'cyber-squatting' and violated the Connecticut Unfair Trade Practices Act when he created the domain name www.foxwood.com and attempted to profit from Internet surfers looking for information about the world's largest casino.

"Ray Redican Jr., who tried to sell the domain name to the Mashantucket Pequots, owners of Foxwoods Resort Casino, for $19,999,999, must turn the site over to the tribe once the Mashantuckets have reimbursed him for registering the site and maintaining the registration.

"The 23-page decision followed a brief trial last summer in U.S. District Court in Bridgeport. Redican had registered the Foxwood site and several other domain names in the late 1990s. Redican said he intended to build a group of sites related to communities bearing the name Foxwood.

"The tribe sued Redican for trademark violation in 2002 after he refused to obey a cease-and-desist letter from its legal office. The casino's actual Web site is at www.foxwoods.com, and tribal officials said a few customers reported they had arrived mistakenly at Redican's site and confused it with the official version.

"The Mashantuckets have consistently refused to pay people who register highly marketable domain names with the intent of selling them at great profit, according to Jackson T. King, lead counsel for the Mashantuckets…"
