Florida Casino Noise Solution Sought - Tuesday 28th of February 2006

FLORIDA – As reported by the Miami Herald: "The state may step in to help some East Davie residents who have long complained of the loud bass noise emanating from the Seminole Hard Rock Hotel & Casino.

"The office of state Rep. Tim Ryan, D-Dania Beach, which represents parts of East Davie, is asking Gov. Jeb Bush to include ways for residents and cities to have a voice in problems such as traffic and noise in his gaming compact with the Seminole Tribe, currently under negotiation.

"There is no guarantee that the provision will make it into Bush's pact with the tribe, but the news comes as welcome relief to Karen Stenzel-Nowicki, an eastside resident who has led efforts to lower the noise that booms from the casino and hotel complex every night.

"…Stenzel-Nowicki and other residents have repeatedly asked Davie to forge a noise-abatement pact with the Seminole Tribe, but town leaders have said their hands are tied because the tribe's lands are considered sovereign. That means noise restrictions do not apply to cultural activities, such as semi-annual powwows and celebrations.

"…Florida Assistant Attorney General Jonathan Glogau told her the tribe's sovereign status left her with few options.

"…The protections that may eventually appear in the compact are not noise-specific, Carter said, but are designed to give residents a way to work with the Seminole Tribe on a host of issues, including traffic…"
