Casino beach bar draws $50,000 fine - Sunday 12th of June 2005

It seems Resorts was a bit too naughty in its desire to bring the "sexiest party on Earth" to the Atlantic City beachfront this summer.The casino has been slapped with a $50,000 fine for building the newly opened Nikki Beach Club without formal authorization from the state Department of Environmental Protection.Construction of the 63,000-square-foot bar and entertainment complex occurred before the DEP approved Resorts Atlantic City's application for a Coastal Area Facilities Review Act permit, which is required for oceanfront development.

"That is the whole problem. They went ahead and constructed the structure without waiting for DEP to approve their CAFRA permit," department spokeswoman Erin Phalon said in an interview Tuesday.Resorts also may have erected Nikki Beach's concert stage and bars too close to the ocean, putting customers and the entire complex at risk during extreme high tide or coastal storms, Phalon said."The point is that any structure, even seasonal structures that are placed in the area of dynamic beach conditions, warrant a careful review and analysis to make sure the beach and the structure can coexist," she said.Nicholas R. Amato, Resorts' general counsel, said the bar was built consistent with the beach's high-water mark and poses no danger whatsoever."Resorts will never, ever put anyone in harm's way, which includes our employees and invited guests," he said. "We would never do that.

We're comfortable that when this whole process is done, the project is deemed safe and enjoyable."Nikki Beach, a haven of hedonism proclaimed by the international press as the "sexiest party on Earth," represents a new level of sophistication in the Atlantic City beach bar scene. Atlantic City joins such exotic locations as South Beach, Miami, St. Tropez in the French Riviera and the Caribbean playground of St. Barths in having the franchise.

Resorts has introduced the trendy watering hole as part of its efforts to give the once-dowdy Boardwalk casino a younger, hipper and sexier makeover. The complex is split into three components: an ultra-chic party spot, a casual bar and a concert stage.Resorts submitted its CAFRA application to the DEP in March, but did not wait for the agency's go-ahead to begin construction, Phalon said. DEP documents show that Resorts was notified of the CAFRA violation last Thursday, the same day Nikki Beach kicked off a Memorial Day weekend grand-opening celebration that included a Saturday night concert by hip-hop superstar Ja Rule.Amato said negotiations continue between Resorts and the DEP, but he declined to comment on the details of the violation.

He said the casino will provide a full public explanation after the matter is resolved."We take every notice of a violation from the DEP and CAFRA seriously and would never do anything intentionally to violate any rule or regulation," he said.In the meantime, the beach bar will stay open. Phalon said the DEP has no plans to shut it down, although she noted that city officials could step in and order it closed if all regulatory permits weren't in place."That's not something that we're looking at right now. The DEP wouldn't shut down the bar," she said.Depending on the outcome of negotiations, the DEP could order Resorts to change the bar's construction to comply with the permit requirements. She stressed there are no plans by the DEP to completely demolish it.
