Lawsuit Filed Against MGM Companies
MICHIGAN – Prominent attorney MayerMorganroth has filed a 69 million dollar lawsuit in Detroit demanding a trialby jury against MGM GRAND DETROIT, LLC, MGM GRAND RESORTS, LLC and MGM MIRAGE,INC. Morganroth charges that agents of MGM acted in premeditated conspiracyto cheat L.S. Brinker/Brinker Team Construction Co and two subsidiaries, CityCarpet & Flooring, Inc. and Universal Glass and Metals, Inc., all of Michigan,out of millions of dollars.
Brinker in joint venture with Perini Building Company of Arizona wascontracted to build the new multi-million dollar MGM Grand Detroit Casino andhotel. The casino currently operating must be updated by a permanent casinoand the new hotel to comply with the operating arrangement between MGM and theCity of Detroit.
The complaint says the key man for the Brinker/Perini joint venture, DavidAgnello, in charge of planning and execution of constructing the hotel,betrayed Brinker.
"In simple terms," Morganroth said, "Mr. Agnello not only stole, convertedand delivered trade secrets, plans and details to MGM's Senior Vice Presidentof Construction, Benjamin Mammina, he betrayed the trust he swore to uphold asan employee."
"This is the man who, in a position of trust, had all confidential andproprietary trade secret information belonging to the joint ventureBrinker/Perini including cost estimates, budgets, projected profits,scheduling, subcontractors, construction strategies and more. Agnello notonly betrayed Brinker, he failed to live up to fiduciary responsibilities,"Morganroth charged.
Morganroth said Agnello willfully colluded with MGM representatives tosteal the job from Brinker and did in fact cut a deal where he would leave andestablish his own company, which he did earlier this year.
"After Agnello set up his new company, Tre Builders," Morganroth said."MGM, specifically Benjamin Mammina, sent a notice to Larry Brinker saying MGMwas canceling the contract with Brinker/Perini." Morganroth continued, "Insheer arrogance, MGM then contracted with Agnello's Tre Builders to constructthe MGM Detroit properties thereby unjustly cheating Brinker and subsidiariesout of millions of dollars."
